SkinChat Terms of Use

Welcome to SkinChat, an AI-driven skincare platform that offers intelligent skin analysis, personalized skincare regimens, product recommendations, and more. These Terms of Use (“Terms”) govern your access to and use of our services, including the SkinChat app, website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree, do not access or use the Service.
Acceptance of Terms
By using SkinChat, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our platform. Continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
Eligibility
You must be at least 18 years of age to use the Service. By accessing or using SkinChat, you represent and warrant that you meet this age requirement.
User Accounts
To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.
• Account Creation: You agree to provide accurate, current, and complete information during the account registration process.
• Account Security: You are solely responsible for the security of your account and agree to notify us immediately of any unauthorized use or suspected breach of security.
Use of the service
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

• User Content: By submitting content to the Service, you grant SkinChat a non-exclusive, royalty-free, worldwide license to use, modify, and display such content for the purpose of providing the Service.
• Restrictions: You may not copy, distribute, modify, or create derivative works from any content or materials on the platform without our express written consent.

Subscription Service and Payments
During the beta phase, SkinChat offers its conversational AI services free of charge. After the beta phase, SkinChat will introduce subscription-based services for access to additional premium features and content.
• Billing: By subscribing to any paid services, you agree to pay the applicable fees as outlined at the time of purchase. Subscription fees will be charged in advance on a recurring basis, as per the terms of your selected plan, unless you cancel in accordance with these Terms.
• Cancellations: You may cancel your subscription at any time through your account settings or by contacting customer support. During the beta phase, no fess will be charged. After the beta phase, refunds for cancellations will be subject to SkinChat’s refund policy, which will be provided upon the introduction of subscription plans. No refunds will be issued for partial subscription periods, except as required by applicable law.

SkinChat provides skincare analysis and recommendations using AI technology. However, the Service is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a healthcare provider for medical concerns related to skin conditions or treatments.
• No Warranties: The Service is provided “as is” and “as available”, without any warranties of any kind, express or implied. We do not warrant the accuracy, completeness, or reliability of the Service.
• Limitation of Liability: To the fullest extent permitted by law, SkinChat and is affiliates will not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Service.
Termination
We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for any violation of these Terms or conduct deemed harmful to SkinChat or its users.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the People’s Republic of China or, where applicable, the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.
• Mainland China Disputes: Any disputes arising out of or related to these Terms involving matters in mainland China shall be resolved through arbitration in accordance with the rules of the China international Economic and Trade Arbitration Commission (CIETAC). Arbitration will be held in Shanghai, China, and the language of arbitration shall be Chinese.
• Hong Kong and International Disputes: For disputes involving Hong Kong or international matters, arbitration shall be conducted in accordance with the rules of the Hong Kong International Arbitration Centre (HKIAC). Arbitration will be held in Hong Kong, and the language of arbitration shall be either in English or Chinese, as agreed by the parties.
Changes to the Service
We reserve the right to modify, suspend, or discontinue any features or functionality of the Service at any time without notice or liability.
